Man who helped make machine guns cried constitution

Daniel Spain, 51, argued that a three-year mandatory minimum sentence was a violation of his charter rights. His application was tossed. Spain pleaded guilty to two counts of manufacturing prohibited firearms and was sentenced to 42 months. He worked for Perfection Métal, a company based in LaSalle where its owner Jean-Pierre Huot made scores of Tec-9 machine guns.

Huot was convicted on six similar charges despite his claims that he was merely making paintball guns. He was sentenced to seven years in prison. Huot is appealing. Huot's guns were used in numerous organized crime hits around Montreal, including the Aug 1, 2014 murder of high profile gangster Ducarme Joseph.
